HIBBING, MN -- A Marble, Minnesota man has been charged with two counts of Criminal Vehicular Homicide in connection with a fatal head-on crash in November.
According to a criminal complaint, Thomas Gilley, 26, was under the influence of drugs at the time of the crash the crash happened along Highway 5 on November 12.
Hibbing Police said Gilley had bloodshot, watery eyes and kept nodding off while one of the officers spoke with him.
When asked what happened, Gilley told police he wasn't sure, but when he opened his eyes "a car was headed right at him".
Inside his SUV, police found a small, crumpled up piece of tin foil, a broken syringe and a spoon containing an off-white residue.
Police also found a hypodermic syringe, black pipe and an orange cylinder containing marijuana in Gilley's left pants pocket.
Gilley is currently in custody in Isanti County.
A warrant is being requested for his arrest.
The victim in the crash was identified as 40-year-old Franklin Rice.
