Duluth Edison formally files lawsuit response

DULUTH, MN – Duluth Edison is standing by its denial of any allegations of racial discrimination, according to an official response filed by the charter school in district court.

A lawsuit filed in early April by three families with students of color alleges they have experienced racist, unfair, hurtful and, at times, dangerous interaction with staff and students at Duluth Edison.

The families are seeking a permanent injunction, directing the school to comply with the law. They’re also asking for monetary relief. An exact amount would be determined in court.

In its response, Duluth Edison says the complaint fails to state a claim upon which relief can be granted.

The school also says it acted in good faith and in full compliance with the law.

It also says any harm or other detriments were not caused by the district.

The district is asking for dismissal of the case with prejudice.
